Notarial Journal Book: An official record book of notarizations performed by a Notarial. TEXAS NOTARIAL SEAL / TEXAS NOTARIAL PUBLIC STAMP

Tex. Gov't. Code Ann. ß 406.013 requires a Notarial Public to use a seal of office to authenticate the Notarial Publicís official acts. Section 406.013 states:

A Notarial public shall provide a seal of office that clearly shows, when embossed, stamped, or printed on a document, the words "Notarial Public, State of Texas" around a star of five points, the Notarial public's name, and the date the Notarial public's commission expires. The Notarial public shall authenticate all official acts with the seal of office.
The seal may be a circular form not more than two inches in diameter or a rectangular form not more than one inch in width and 2Ω inches in length. The seal must have a serrated or milled edge border.
The seal must be affixed by a seal press or stamp that embosses or prints a seal that legibly reproduces the required elements of the seal under photographic methods. An indelible inkpad must be used for affixing by a stamp the impression of a seal on an instrument to authenticate the Notarial public's official act.
Subsection (c) does not apply to an electronically transmitted authenticated document, except that an electronically transmitted authenticated document must legibly reproduce the required elements of the seal.

California Notarial Seal

California Notarial Public Bond

A Notarial public is required to purchase and file an official bond with the county clerk's office in the county where their principal place of business is located within 30 calendar days from the commencement date of the commission. (Government Code section 8213.)

A Notarial public may utilize any bonding or insurance company of their choice. Check the local telephone directory's yellow pages under the heading "Bonds".

California Notarial Public Journal

A California Notarial public is required to keep and maintain one active sequential journal for all their notarial acts. Journals may be purchased by clicking on the Journal Image above. Be sure that your journal has sufficient space for you to record the required entries. (Government Code section 8206.)

California Notarial Public Candidate Information / Fees

Frequency of Testing: Candidates can test ONLY once per calendar month. If the exam is taken more than once in a calendar month, the second score will be invalid and any fees paid will be forfeited.

Reappointments: Candidates applying for reappointment are not encouraged to test more then twelve months in advance of the commission expiration.

Result Notification: Results from your Notarial Public Examination will be sent 15 business days following the exam. Result information will not be discussed over the phone. A SCORE OF 70 IS PASSING.

Candidates passing the examination: All persons appointed as a Notarial Public are required to undergo a background check by the California Department of Justice and the Federal Bureau of Investigation for each and every Notarial Public Appointment.

Candidates not passing the exam will be mailed a fail notice.

When retaking the exam, please submit:

Fail notification letter (if applicable),
Completed application form,
The original Proof of Completion from your mandatory education class, if you have completed the course,
2" x 2" color passport photograph of yourself,
A check, cashiers check, or money order for $20.00 made payable to the Secretary of State.

Rescoring Test Results: Requests for rescoring test results must be submitted in writing and accompanied with a $20.00 money order only, payable to CPS.

No checks or cash will be accepted. Rescoring requests must be received by CPS within 45 days after the test date at the following address: 241 Lathrop Way, Sacramento, CA 95815, ATTN: Notarial Public Exam Services. Processing of these requests will be handled on a daily basis.

California Notarial Commission: Notarial Public commissions are issued from the Secretary of Stateís Office, Notarial Public Section.

Emergency Test Center Closure: Inclement weather or other emergencies may force the closure of a test center on the scheduled test date. In that event, the examination will be rescheduled. All registered candidates will receive notification of the new date and time of the test.

California NotarialFees: Each candidate must have a separate check or money order. Receipts are available upon request at the test site. CASH CANNOT BE ACCEPTED. Fees are to be paid by check or money order only made payable to the SECRETARY OF STATE, according to the following fee schedule:

New applicants and Reappointments: $40.00
Applicants who have previously taken the exam and failed: $20.00

What should I do when I affix my Notarial seal to a document and do not get a legible imprint?

Illinois Notarial Seal

†Every Illinois Notarial public must obtain and use a rubber stamp seal no more than one

inch in height and two and one-half inches in length (Sec. 3-101). Although the

law does not prescribe the exact format of the seal, the following example contains

all of the required information and is acceptable. In this case, the Notarialís name

is John H. Doe, whose Notarial appointment expires Dec. 31, 2012.

Illinois Notarial Stamp

What is a Notarial Seal ?

An official stamp or embosser used by a Notarial to seal notarizations. It must be kept under the direct and exclusive control of the Notarial.

FUNCTIONS OF A NOTARIAL PUBLIC

Notarial Acts ñ An Illinois Notarial public is authorized to perform notarial acts

or ìnotarizationî anywhere in the state. Notarial acts include taking an

acknowledgment, taking a verification upon oath or affirmation, witnessing or

attesting a signature, administering an oath or affirmation, and performing any

other act authorized by law.

Identification ñ A Notarial public must positively identify the person requesting

notarization. A Notarial has positive identification if the person (a) is personally

known to the Notarial; (b) is identified upon the oath or affirmation of a credible

witness personally known to the Notarial; or (c) is identified on the basis of

identification documents.

Pennsylvania Notarial Seal

Notaries public commissioned in Pennsylvania are required to use a rubber stamp seal for all notarial acts on paper. Notaries may use an embosser in addition to the rubber stamp seal; however the embosser is optional. The rubber stamp seal must show clearly in the following order the words "Notarial Seal", the name and surname of the Notarial public and the words "Notarial Public", the name of the municipality (not the political subdivision as was the case under the Pennsylvania Notarial Public Law prior to amendments brought about by Act 151 of 2002) and the county in which the Notarial maintains an office and the date the Pennsylvania Notarial's commission expires. This seal shall have a maximum height of one inch and a width of three and one-half inches with a plain border.

Please note that since Act 151 of 2002 does not require the rubber stamp seal to contain a reference to the state of Pennsylvania following the name of the municipality and county in which the Notarial public maintains an office, the Notarial public may wish to exercise the option of using an embosser in conjunction with the seal or add the preprinted words "Commonwealth of Pennsylvania" outside the top of the plain border of the seal.

In performing a notarization in Pennsylvania, a Notarial public must ensure that the rubber stamp seal is stamped in a prominent place on the official notarial certificate near the Notarial public's signature in such a manner as to be capable of photographic reproduction. The amended Notarial Public Law explicitly provides that the Notarial public's seal is the exclusive property of the Notarial public to whom it is issued. The Notarial public is responsible for the custody and control of the seal at all times and shall not permit the use of his/her seal by another person. The use of a Notarial public seal by a person who is not the Notarial public on the seal will be deemed an impersonation of a Notarial public and the individual will be subject to criminal penalties.

NOTARIAL REGISTER / NOTARIAL PUBLIC REGISTER

Every Notarial public must keep and maintain custody and control of an accurate chronological register of all official acts. The register must contain the date of the act, the character or type of the notarial act, the date and the parties to the instrument, and the amount of the fee collected. Each notarization performed by the Notarial must be indicated separately.

A Notarial public register is the exclusive property of the Notarial public, may not be used by any other person and may not be surrendered to any employer of the Notarial public upon termination of employment. When required, each Notarial public must give a certified copy of the register in the Notarial public's office to any person requesting it. The register and other public records of the Notarial public shall not be liable to be seized, attached or taken in execution for debt for any demand whatsoever.

A Notarial public has 30 days to deliver his/her register to the office of the recorder of deeds of the proper county after his/her resignation, death or disqualification or upon the revocation or expiration of a commission, unless he/she applies for a new commission within 30 days of the expiration of the prior commission.

A Notarial public must maintain an accurate register throughout his/her commission. Even if he/she ceases to be a Notarial public because of, for example, resignation or commission expiration, it is recommended that the individual permanently retain a copy of the register for his/her own protection from possible future findings of liability.
